Porter should face inquiry, say lawyers

Without presumption of innocence we are on shifting sands

It is dangerous to call for inquiries that stand outside the law that alone decides between guilt and innocence.

There is no doubt that rape is one of the most heinous of crimes.

We all agree that those convicted of such crimes are reprehensible. They are not fit and proper people to hold public office.

The silence has been deafening.

The nation’s legal associations and its peak body, the Law Council, have gone to ground since historic rape allegations were made against Attorney-General Christian Porter

Lawyers’ silence on Porter has been deafening

Leading lawyers have insisted there should be an independent inquiry into rape allegations against Attorney-General Christian Porter, saying it was “about having confidence in him and the position he holds”.

Barristers Jane Needham, SC, and Larissa Andelman and the immediate past president of the Law Council of Australia, Pauline Wright, also said it might be the only way for Mr Porter to clear his name.

Legal and business experts have said there is no “rule of law” issue with the attorney general, Christian Porter, facing an independent inquiry into an allegation of sexual assault, allegedly committed in 1988.

Porter strenuously denies the allegations that, as a 17-year-old, he raped a 16-year-old girl at a university debating tournament. He told media on Wednesday that if he resigned “there would be no rule of law left to protect in this country”.
