Comprehensive Theory And Style For Using PowerPoint To Teach Law - Questions the IRS Will Not Answer

Dark patterns, the tricks websites use to make you say yes, explained

Vox: “How design can manipulate and coerce you into doing what websites want. If you’re an Instagram user, you may have recently seen a pop-up asking if you want the service to “use your app and website activity” to “provide a better ads experience.” At the bottom there are two boxes: In a slightly darker shade of black than the pop-up background, you can choose to “Make ads less personalized.” A bright blue box urges users to “Make ads more personalized.” This is an example of a dark pattern: design that manipulates or heavily influences users to make certain choices. Instagram uses terms like “activity” and “personalized” instead of “tracking” and “targeting,” so the user may not realize what they’re actually giving the app permission to do. Most people don’t want Instagram and its parent company, Facebook, to know everything they do and everywhere they go. But a “better experience” sounds like a good thing, so Instagram makes the option it wants users to select more prominent and attractive than the one it hopes they’ll avoid…”

When a taxpayer plans to undertake a transaction and its tax consequences are unclear, the taxpayer can request a letter ruling from the IRS. The IRS issues numerous letter rulings each year. In 2020, for instance, the IRS issued 777 letter rulings. The IRS refrains from issuing letter rulings on certain topics. At the beginning of each year, the IRS publishes an updated list of the topics on which it will not rule. Many of the topics on which it will not rule arise in areas of tax law governed by standards where the tax outcome depends heavily on each transaction’s specific facts. This pattern is consistent with the IRS’s stated position that it ordinarily does not rule in certain areas because of the factual nature of the matter involved.

PowerPoint 1This Article is the first to present a comprehensive theory and style for using PowerPoint to teach law. The theory is that presentation software adds a channel of communication that enables the use of images in combination with words. Studies have shown that combination to substantially enhance learning. The style is based on an extensive literature regarding the use of PowerPoint in teaching law and other higher education subjects as well as the author’s experimentation with PowerPoint over two decades. The Article states fourteen principles for slide or slide sequence design, provides the arguments from the literature for and against them, and explains the techniques by which the author implements them. It argues that PowerPoint is effective for eight kinds of presentation
